  • Our Community, Our Standards

    ‍ ‍

    Flavr exists to help people meet over food — real matches, real dates, real people. To make that work, we need everyone on Flavr to treat each other with respect, both in the app and in person. Here's what we expect.

    ‍ ‍

    Be Real

    ‍ ‍

    • Use real, recent photos of yourself. Don't misrepresent who you are.

    • You don't have to use your full legal name — go by whatever name you actually use in your day-to-day life. What matters is that you're representing yourself honestly, not creating a persona or pretending to be someone else.

    • Only make one account. If you've been removed from Flavr before, don't create a new one without our permission.

    • Your profile should be about you — not a business, not a bot, not someone else.

    • Keep your profile free of nudity or sexual content. Consent and comfort matter — what's okay in a private conversation between two adults isn't the same as what belongs on a public profile.

    ‍ ‍

    Keep It Safe to Look At

    ‍ ‍

    • No graphic violence, gore, or content depicting or glorifying self-harm.

    • No weapons displayed in a threatening way, and no content promoting violence against people or animals.

    • If we believe someone may be at risk of harm, we may reach out with safety resources.

    ‍ ‍

    Be Respectful

    ‍ ‍

    • No harassment, threats, or bullying — on the app or off it, before or after a date.

    • No hate speech, discrimination, or content that promotes violence.

    • No unwanted sexual content or messages.

    • Treat your matches the way you'd want to be treated, especially in person.

    ‍ ‍

    Be Safe

    ‍ ‍

    • Never ask another user for money, gifts, or loans — and be cautious if anyone asks you.

    • Don't share another user's personal information (address, financial details, etc.) without their permission.

    • Meet in public places for first dates — that's exactly what Flavr's restaurant partner network is for.

    • If something feels off about another user, trust your instincts and report it.

    ‍ ‍

    Don't Misuse the Platform

    ‍ ‍

    • No spam, scams, or commercial solicitation.

    • No bots, scrapers, or automated tools.

    • No attempts to hack, exploit, or interfere with the app.

    • No fake reports about other users made to harass or retaliate against them.

    ‍ ‍

    Reporting and Blocking

    ‍ ‍

    If another user makes you uncomfortable or violates these guidelines, you can report or block them directly from their profile or a conversation. Reports are reviewed by our team, and violations can result in a warning, suspension, or permanent ban depending on severity.

    ‍ ‍

    If you ever feel unsafe, please also consider reaching out to local authorities. Flavr's tools help us moderate the platform, but they aren't a substitute for real-world safety precautions.

    ‍ ‍

    Questions?

    ‍ ‍

    Reach out to us at support@flavrprofile.app if you have questions about these Guidelines or want to report something that doesn't fit neatly into the categories above.

  • 1. Introduction

    This Privacy Policy explains how Flavr Profile Inc. ("Flavr," "we," "us," or "our") collects, uses, and shares information when you use the Flavr mobile application and related services (the "Service"). This Policy is incorporated by reference into our Terms of Service.

    2. Information We Collect

    2.1 Information You Provide.

    • Account information (name, email, phone number, date of birth for age verification)

    • Profile information (photos, bio, food and dining preferences, dietary restrictions/allergies)

    • Messages and communications with other users

    • Information you provide when contacting customer support

    2.2 Information Collected Automatically.

    • Device information (device type, operating system, unique device identifiers)

    • Usage data (how you interact with the Service, features used, session length)

    • Location data — [FLAG FOR REVIEW — this is the highest-risk data category Flavr collects; see Section 3 below] with your permission, Flavr collects precise geolocation data, including at or near the time of a scheduled date, to verify that a date occurred at a partner restaurant venue.

    2.3 Information From Third Parties.

    • If you sign up or log in using a third-party service (e.g., Apple, Google), we may receive basic profile information from that service, subject to your permissions with that provider.

    3. Location Data — Special Notice

    [FLAG FOR REVIEW — this entire section should be reviewed carefully by counsel; precise geolocation is treated as sensitive personal information under CCPA/CPRA and California's regulations impose specific disclosure obligations]

    3.1 Why We Collect It. Flavr uses location data specifically to verify that a confirmed date between matched users occurred at a partner restaurant venue ("Date Verification"), which determines the referral fee owed by that restaurant partner to Flavr.

    3.2 Your Choice. Location sharing is permission-based. You can decline or revoke location access at any time through your device settings, though this may limit Date Verification-dependent features.

    3.3 Retention. [PLACEHOLDER — define specific retention period for location data; should be no longer than necessary for the CPA billing/dispute-resolution cycle described in the restaurant partner agreement]

    3.4 Who Sees It. Restaurant partners do not receive your precise location data directly — they receive a confirmation that a Confirmed Date occurred at their venue, not raw location coordinates. [FLAG FOR REVIEW — confirm this matches Toby's actual implementation before publishing; if partners receive anything more granular than a confirmation flag, this section and the CCPA "sale/share" analysis below need to be revised accordingly]

    4. How We Use Information

    We use the information we collect to:

    • Operate core matching and messaging functionality

    • Recommend restaurant, café, and bar venues based on your preferences

    • Verify Confirmed Dates for restaurant partner billing purposes (see Section 3)

    • Communicate with you about the Service

    • Improve and maintain the Service, including through basic usage analytics

    • Detect fraud, abuse, and violations of our Terms of Service

    • Comply with legal obligations

    5. How We Share Information

    5.1 Restaurant Partners. As described in Section 3, restaurant partners receive confirmation that a Confirmed Date occurred at their venue for billing purposes. [FLAG FOR REVIEW — confirm exactly what data point(s) partners receive] Flavr does not share your name, contact information, or messages with restaurant partners without your consent.

    5.2 Aggregate/Anonymized Data. We may share aggregate or anonymized preference data with restaurant partners to improve recommendation relevance. This data does not identify you individually.

    5.3 Service Providers. We share information with third-party service providers who perform services on our behalf, including:

    • Cloud hosting and infrastructure providers

    • Google Maps (for venue recommendations and mapping)

    • AI/language model providers (for features such as generating suggested conversation openers or evaluating restaurant menu compatibility with your preferences)

    • Payment processing providers (note: this applies to Flavr's billing relationship with restaurant partners only — Flavr does not process payments from users; see Section 5.4)

    5.4 No Sale of User Payment Data. Flavr does not charge users for the Service and does not process user payment information. Our payment processor (Stripe) is used exclusively for business-to-business billing with restaurant partners.

    5.5 Legal Requirements. We may disclose information if required by law, legal process, or to protect the rights, property, or safety of Flavr, our users, or the public.

    5.6 Business Transfers. If Flavr is involved in a merger, acquisition, or sale of assets, user information may be transferred as part of that transaction, subject to standard protections.

    5.7 [FLAG FOR REVIEW — required under CCPA/CPRA] "Sale" and "Sharing" of Personal Information. [PLACEHOLDER — counsel should confirm whether any of the data-sharing described above (particularly with Google Maps, AI providers, or restaurant partners) legally constitutes a "sale" or "sharing" of personal information under CCPA/CPRA definitions, which would require additional opt-out mechanics under Section 8 below.]

    6. Data Retention

    [PLACEHOLDER — Flavr should define specific retention periods for each data category (account data, messages, location data, deleted-account data) before publishing. As a general principle, information should be retained only as long as necessary for the purposes described in this Policy, or as required by law.]

    7. Data Security

    We use reasonable administrative, technical, and physical safeguards designed to protect your information. However, no method of transmission or storage is completely secure, and we cannot guarantee absolute security.

    8. Your Privacy Rights

    8.1 General Controls. You can access and update most of your profile information directly within the Service. You can delete your account at any time through account settings.

    8.2 California Residents (CCPA/CPRA). [FLAG FOR REVIEW — this section should be finalized by counsel given Flavr's California operations and its use of location data, which California treats as sensitive personal information] If you are a California resident, you have the right to:

    • Know what personal information we collect, use, and disclose about you

    • Request deletion of your personal information, subject to certain exceptions

    • Correct inaccurate personal information

    • Opt out of the "sale" or "sharing" of your personal information, if applicable (see Section 5.7)

    • Limit the use of sensitive personal information (which may include precise geolocation)

    • Not be discriminated against for exercising these rights

    To exercise these rights, contact us at [PRIVACY CONTACT EMAIL — PLACEHOLDER].

    8.3 Other Jurisdictions. [PLACEHOLDER — if Flavr expands beyond California/US, additional jurisdiction-specific rights sections (e.g., GDPR for EU users) would need to be added at that time. Not applicable at current launch scope.]

    9. Children's Privacy

    The Service is not intended for anyone under 18. We do not knowingly collect personal information from anyone under 18. If we learn we have collected information from someone under 18, we will delete it.

    10. Changes to This Policy

    We may update this Privacy Policy from time to time. If we make a material change, we will provide notice through the Service, by email, or by other reasonable means, and update the "Last Updated" date above.

    11. Contact Us

    Questions about this Privacy Policy or your personal information can be directed to: support@flavrprofile.app

  • 1. Acceptance of Terms

    These Terms of Service ("Terms") govern your access to and use of the Flavr mobile application and related services (collectively, the "Service"), operated by Flavr Profile Inc. ("Flavr," "we," "us," or "our"). By creating an account or otherwise using the Service, you agree to be bound by these Terms and our Privacy Policy, which is incorporated by reference.

    If you do not agree to these Terms, do not use the Service.

    We may update these Terms from time to time. If we make a material change, we will provide notice through the Service, by email, or by other reasonable means, and will update the "Last Updated" date above. Your continued use of the Service after a change takes effect means you accept the revised Terms. If you do not accept a change, you must stop using the Service.

    2. Eligibility

    You are not authorized to create an account or use the Service unless all of the following are true. By using the Service, you represent and warrant that:

    2.1 You are an individual (not a company, partnership, or other entity) at least 18 years old;

    2.2 You are legally capable of entering into a binding contract with Flavr and are not barred from using the Service under the laws of the United States or any other applicable jurisdiction;

    2.3 [FLAG FOR REVIEW — confirm whether Flavr wants to include this exclusion at launch; common in the dating-app category but adds a representation Flavr cannot independently verify] You have not been convicted of, or pled no contest to, a crime involving violence, a threat of violence, or sexual misconduct, and you are not required to register as a sex offender in any jurisdiction;

    2.4 You do not have any other active Flavr account, and you have not previously been removed from the Service by Flavr, unless you have Flavr's express written permission to create a new account;

    2.5 You are not impersonating any other person or creating an account on behalf of someone else without authorization.

    If you cease to meet any of these requirements at any time, your authorization to use the Service is automatically revoked, and Flavr may suspend or terminate your account without notice.

    3. Your Responsibilities and Prohibited Conduct

    3.1 Your Responsibilities. You agree to: comply with these Terms and applicable law; keep your account information accurate and up to date; maintain the security of your login credentials; and treat other users respectfully, both on and off the Service.

    3.2 Prohibited Conduct. You agree that you will not:

    • Misrepresent your identity, age, employment, or affiliations;

    • Harass, threaten, stalk, intimidate, defame, or otherwise mistreat any person;

    • Solicit money, gifts, loans, or other items of value from another user;

    • Use another user's account, or share your own account credentials with anyone else;

    • Use the Service for any commercial solicitation, unauthorized advertising, spam, or pyramid-type scheme;

    • Post content that is obscene, discriminatory, threatening, or that promotes hatred, violence, or illegal activity;

    • Disclose another user's personal contact, banking, or payment information without consent;

    • Use any bot, scraper, crawler, or automated tool to access, index, or extract data from the Service;

    • Attempt to reverse engineer, decompile, or otherwise access the underlying source code of the Service;

    • Probe, scan, or attempt to compromise the security of the Service or its networks;

    • Create a new account after Flavr has suspended or terminated a prior account, without Flavr's express permission;

    • Submit a report about another user's conduct that is knowingly false or made in bad faith;

    • Use the Service to arrange a meeting, transaction, or interaction for any unlawful purpose.

    3.3 Violation of this Section may result in suspension or termination of your account, at Flavr's sole discretion, with or without notice.

    4. The Service

    4.1 Matching. Flavr allows users to create profiles based on food and dining preferences and to match with other users. Matching and messaging within the Service are provided to users free of charge, with no limit on the number of matches, and Flavr does not currently intend to charge users for core matching functionality.

    4.2 No Guarantee of Outcome. Flavr does not guarantee that you will be matched with any particular person, that a match will result in a date, or that any date will be successful. You are solely responsible for your interactions with other users, both online and in person.

    4.3 Restaurant Recommendations and Date Confirmation. The Service may recommend restaurant, café, or bar venues ("Partner Venues") to matched users for the purposes of an in-person date. Some features of the Service rely on confirming that a date took place at a Partner Venue, as described in Section 7 below.

    5. Your Safety and Interactions With Other Users

    5.1 In-Person Meetings. Flavr facilitates connections between users but does not participate in, supervise, or guarantee the safety of any in-person meeting. You are solely responsible for your own safety when meeting another user. We strongly recommend meeting in public places, telling a friend or family member where you are going, and using your own judgment before and during any in-person meeting.

    5.2 No Background or Identity Verification. [FLAG FOR REVIEW — confirm accuracy against actual verification method before publishing] FLAVR DOES NOT CONDUCT CRIMINAL BACKGROUND CHECKS OR INDEPENDENT IDENTITY VERIFICATION ON ITS USERS BEYOND [DESCRIBE METHOD, E.G., PHONE NUMBER OR EMAIL VERIFICATION]. FLAVR MAKES NO REPRESENTATION OR WARRANTY REGARDING ANY USER'S IDENTITY, INTENTIONS, CONDUCT, OR BACKGROUND. YOU ARE SOLELY RESPONSIBLE FOR EXERCISING YOUR OWN JUDGMENT WHEN DECIDING TO INTERACT WITH, MEET, OR SHARE INFORMATION WITH ANY OTHER USER.

    6. Food Allergies and Dietary Information

    6.1 User-Provided Information. The Service may allow you to indicate dietary preferences, restrictions, or allergies as part of your profile. This information is provided by you and is used to inform matching and restaurant recommendations only.

    6.2 No Medical or Safety Guarantee. [FLAG FOR REVIEW — this is a material liability disclaimer and should be reviewed by counsel] Flavr does not verify, and is not responsible for, the accuracy of any dietary or allergy information provided by users or Partner Venues. Flavr does not guarantee that any Partner Venue can safely accommodate any dietary restriction or allergy. You are solely responsible for communicating your dietary needs or allergies directly to restaurant staff and for making informed decisions about what you consume. Flavr is not liable for any allergic reaction, illness, or injury arising from food or beverages consumed at a Partner Venue or otherwise.

    7. Date Verification and Location Data

    7.1 Purpose. To operate the CPA-based (cost-per-acquisition) relationship between Flavr and Partner Venues described in our business model, the Service may use location data to help confirm that a date between matched users took place at a Partner Venue.

    7.2 Location Data Collection. [FLAG FOR REVIEW — this section has real regulatory exposure (CCPA and similar state laws) and should be reviewed carefully by counsel before publishing] With your permission, the Service may collect precise geolocation data from your device, including at or near the time of a scheduled date, for the purpose of verifying that a date occurred at a Partner Venue ("Date Verification"). You may decline to share location data, but doing so may limit certain features of the Service.

    7.3 How Location Data Is Used. Location data collected for Date Verification is used to: (a) confirm that a CPA-triggering date occurred at a Partner Venue; (b) calculate fees owed by Partner Venues to Flavr; and (c) improve the Service. Location data is not sold to third parties. [FLAG FOR REVIEW — confirm retention period, whether Partner Venues receive precise location data or only a confirmation flag, and whether this triggers "sale" or "sharing" definitions under CCPA]

    7.4 Your Controls. You can disable location sharing at any time through your device settings, subject to Section 7.2.

    8. Restaurant Partner Advertising and Recommendations

    8.1 Partner Venues may pay Flavr for placement in restaurant recommendations shown to users ("Native Advertising"). Native Advertising is based on your stated food and dining preferences and general match activity; it does not involve the sale of your personal contact information to Partner Venues.

    8.2 [FLAG FOR REVIEW — confirm exactly what data, if any, is shared with Partner Venues beyond aggregate/anonymized preference data, and disclose accordingly] Aggregate or anonymized preference data may be shared with Partner Venues to improve recommendation relevance. Flavr does not share your individual identity, contact information, or messages with Partner Venues without your consent, except as necessary to complete Date Verification under Section 7.

    8.3 Third-Party Links. The Service may contain links to third-party websites or services (including Partner Venue websites, ordering platforms, or social media). Flavr does not endorse and is not responsible for the content, policies, or practices of any third-party site. Your interactions with third parties are solely between you and that party.

    9. Fees to Users

    Flavr does not currently charge users any fee to create an account, match with other users, or message other users. We reserve the right to introduce optional paid features in the future; if we do, we will provide notice and obtain your consent before charging you.

    10. Content and Intellectual Property

    10.1 Our Content. The Service, including its design, text, graphics, logos, trademarks, and underlying software (collectively, "Our Content"), is owned by Flavr or its licensors and is protected by intellectual property law. Flavr grants you a limited, personal, non-exclusive, revocable, non-transferable license to access and use Our Content solely as necessary to use the Service as intended.

    10.2 Your Content. You retain ownership of the content you submit to the Service, such as profile photos, bio text, and preference information ("Your Content"). By submitting Your Content, you grant Flavr a non-exclusive, worldwide, royalty-free, sublicensable license to host, store, display, reproduce, and distribute Your Content solely in connection with operating, providing, and promoting the Service. You represent that you have the rights necessary to grant this license and that Your Content does not violate any third party's rights.

    10.3 Member Content. Content that other users share on the Service ("Member Content") belongs to the user who posted it. You may not copy, reproduce, or use Member Content for any purpose outside the intended purpose of the Service (i.e., communicating with and meeting other users), including for commercial purposes.

    10.4 Feedback. If you submit suggestions or feedback about the Service, you agree Flavr may use that feedback for any purpose without compensating you.

    10.5 Copyright Complaints (DMCA). [FLAG FOR REVIEW — confirm designated agent registration before publishing; see internal note below on whether formal U.S. Copyright Office registration, which requires a public address, is needed at this stage] If you believe content on the Service infringes your copyright, you may submit a notice to support@flavrprofile.app that includes: identification of the copyrighted work; identification of the allegedly infringing material and its location on the Service; your contact information; a statement of good-faith belief that the use is unauthorized; and a statement, under penalty of perjury, that the notice is accurate and that you are authorized to act on the copyright owner's behalf. Flavr will terminate the accounts of repeat infringers.

    11. Disclaimers

    11.1 THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

    11.2 FLAVR DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT ANY MATCH, DATE, OR RESTAURANT RECOMMENDATION WILL MEET YOUR EXPECTATIONS. FLAVR MAKES NO GUARANTEE AS TO THE NUMBER OF ACTIVE USERS AT ANY TIME OR THE CONDUCT OF ANY USER YOU MEET THROUGH THE SERVICE.

    12. Limitation of Liability

    [FLAG FOR REVIEW — standard liability cap language; dollar figures and structure should be set by counsel] TO THE MAXIMUM EXTENT PERMITTED BY LAW, FLAVR AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR DATA, ARISING FROM YOUR USE OF THE SERVICE, INCLUDING BUT NOT LIMITED TO ANY INJURY, ALLERGIC REACTION, OR HARM ARISING FROM AN IN-PERSON MEETING OR VISIT TO A PARTNER VENUE. FLAVR'S TOTAL LIABILITY TO YOU FOR ANY CLAIM RELATING TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) $100 USD, OR (B) THE AMOUNT, IF ANY, YOU PAID FLAVR IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

    13. Indemnification

    You agree to indemnify, defend, and hold harmless Flavr and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from: your use of the Service; Your Content; your violation of these Terms; or your interactions with other users or Partner Venues.

    14. Dispute Resolution

    [FLAG FOR REVIEW — this is a significant business/legal decision, not just boilerplate. Mandatory arbitration and class-action waivers are standard in the dating-app category and reduce litigation exposure, but they are a deliberate choice that should be confirmed with counsel before publishing, and are unenforceable or restricted in some states/countries.]

    14.1 Informal Resolution First. If you have a dispute with Flavr, you agree to first contact us at support@flavrprofile.app and attempt to resolve the dispute informally for at least 30 days before initiating arbitration or a lawsuit.

    14.2 Arbitration. [PLACEHOLDER — if Flavr elects to use binding arbitration, counsel should specify the administering body (e.g., AAA or JAMS), rules, class-action waiver language, and any carve-outs required by law (e.g., sexual assault/harassment claims, which federal law exempts from forced arbitration). Any dispute not resolved informally shall be resolved by binding individual arbitration, except that either party may bring an individual claim in small claims court.]

    14.3 No Class Actions. [PLACEHOLDER — subject to counsel confirmation] To the extent permitted by law, disputes must be brought on an individual basis only, and not as part of any class, consolidated, or representative action.

    15. Governing Law

    These Terms are governed by the laws of the State of [GOVERNING LAW — PLACEHOLDER, TBD], without regard to conflict of law principles.

    16. Termination

    16.1 You may delete your account at any time through the Service's account settings.

    16.2 Flavr may suspend or terminate your account at any time, with or without notice, if we believe you have violated these Terms or otherwise acted in a way that is harmful to other users, Partner Venues, or the Service.

    16.3 Upon termination, these Terms continue to apply to any disputes or claims that arose prior to termination.

    17. General Provisions

    17.1 Entire Agreement. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Flavr regarding the Service and supersede any prior agreements.

    17.2 Severability. If any provision of these Terms is held invalid or unenforceable, the remaining provisions will continue in full force and effect.

    17.3 No Waiver. Flavr's failure to enforce any provision of these Terms is not a waiver of that provision.

    17.4 No Partnership. Nothing in these Terms creates a partnership, joint venture, agency, or employment relationship between you and Flavr.
